1. Scope of Services
1.1 We provide professional gutter-related services, including but not limited to:

- Gutter cleaning and debris removal
- Gutter maintenance and inspection

1.2 The exact scope of work for each job will be described in your quote, work order, or written confirmation provided by Ernest Gutters.
1.3 We reserve the right to refuse or discontinue Services if conditions are unsafe, access is restricted, or information provided is inaccurate or incomplete.
2. Quotes, Estimates & Pricing
2.1 Any quote or estimate we provide is based on the information you give us (photos, descriptions, property details) and/or our site visit.
2.2 Quotes are typically valid for a limited time (e.g., 30 days) from the date issued, unless otherwise stated. After this period, pricing may change.
2.3 If, upon arrival, we discover conditions that differ significantly from what was described (e.g., structural issues, severe damage, hidden obstructions), we may:
- Adjust the price and seek your approval before proceeding, or
- Decline to perform the work if it is unsafe or outside our normal scope.
3. Booking, Scheduling & Access
3.1 Service appointments are scheduled on a first-come, first-served basis. We will make reasonable efforts to accommodate your requested dates and times, but availability is not guaranteed.
3.2 You are responsible for ensuring:
- Safe and reasonable access to the property and gutter areas
- Pets are secured
- Gates are unlocked or access information is provided
- Vehicles or obstacles are moved if needed for ladder placement or equipment access
3.3 If we cannot complete the work due to lack of access or unsafe conditions, a trip or service fee may still apply.
4. Cancellations & Rescheduling
4.1 If you need to cancel or reschedule a service, please notify us as early as possible.
4.2 We reserve the right to charge a cancellation or trip fee if:
- You cancel or reschedule with short notice (e.g., less than 24 hours), or
- We arrive on-site and cannot complete the work due to access or safety issues within your control.
4.3 In case of severe weather, safety concerns, or unforeseen events, we may reschedule your service. We will make reasonable efforts to contact you and arrange a new appointment.
5. Payment Terms
5.1 Unless otherwise agreed in writing, payment is due upon completion of Services.
5.2 We accept payment methods as communicated at the time of service (e.g., cash, check, or other approved forms). Online payments may be added in the future and, if so, may be subject to additional terms.
5.3 If full payment is not received when due, we may:
- Suspend or refuse further Services, and/or
- Charge late fees or interest as permitted by applicable law.
6. Customer Responsibilities
By booking Services, you agree that you will:
- Provide accurate contact information and property details
- Disclose any known structural issues, previous water damage, or hazards
- Ensure the work area is reasonably free of obstructions and accessible
- Follow any care or maintenance instructions we provide after the service
If property conditions cause damage to your gutters or structure (e.g., rotten fascia, loose roofing, previously damaged sections), we are not responsible for such pre-existing issues.
7. Condition of Gutters & Surrounding Structures
7.1 Our work is often performed on existing roofs, fascia boards, and structures that may already be weakened by age, rot, or previous damage.
7.2 While we use reasonable care, we are not responsible for:
- Pre-existing damage to gutters, fascia, roofing, or siding
- Damage resulting from hidden or unsafe conditions that could not reasonably be detected in advance
If we identify significant concerns, we may recommend additional repairs or services.
8. Limited Warranty
8.1 We stand behind the quality of our workmanship. Where stated in writing, certain Services may include a limited workmanship warranty for a specified period.
8.2 Any warranty will be void if:
- Gutters or related systems are altered, repaired, or modified by another provider or the customer, or
- Recommended maintenance is not performed, or
- Damage results from storms, extreme weather, falling branches, settling, or other events beyond our control.
8.3 To make a warranty claim, you must contact us within a reasonable time after discovering the issue and allow us to inspect and address it.
9. Limitation of Liability
9.1 To the fullest extent permitted by law, Ernest Gutters will not be liable for:
- Any indirect, incidental, consequential, special, or punitive damages
- Loss of use, loss of income, or any similar damages arising from or related to our Services or website
9.2 Our total liability for any claim arising out of or relating to our Services will not exceed the amount you paid for the specific Service giving rise to the claim.

10. Photos & Marketing
10.1 We may take before-and-after photos of work performed on your property for documentation and quality control.
10.2 With your consent (which may be given in writing, by email, or via form submission), we may also use non-identifying photos (e.g., no visible address or faces) for marketing, website, or social media purposes.
If you do not want photos of your property used in marketing, please let us know.
11. Website Use & Content
11.1 All content on our website, including text, graphics, logos, images, and layout, is the property of Ernest Gutters or its licensors and is protected by copyright and other intellectual property laws.
11.2 You may view and print content for your personal, non-commercial use in evaluating our Services. You may not copy, reproduce, distribute, or modify website content without our prior written consent.
